Professional Background

Winton Derby practiced as a litigator in the areas of corporate, commercial, securities, family and administrative law and spent over 40 years at a leading national law firm, heading the Litigation group in the Vancouver office for over 10 years.

In 2007, Winton Derby became General Counsel at a large restaurant chain, a relationship that began when Mr. Derby started his legal career. He was also general counsel at a Vancouver based investment firm and oversaw the successful sale of the company to a national brokerage firm.

During Winton’s law career, he appeared in all Courts of British Columbia as well as the Supreme Court of Canada. His experience includes: acting for the largest home improvement retailer in a claim for professional negligence; acting for a large US wood products company in a contract dispute; counsel for an international asbestos firm in respect of 120 personal injury and property cases; acting in a securities case that is still the leading case regarding disclosure pursuant to the Securities Act of British Columbia; and acting in personal injury, slander and family matters.

Winton has represented clients as counsel in numerous arbitrations and mediations as well as acting as an arbitrator and mediator. He now restricts his practice to mediation and arbitration and conducts complicated, multi-party mediations, including but not limited to commercial matters, securities disputes, commercial real estate, and personal injury cases.
